1. Purpose of the services
These Terms and Conditions govern access to the website https://bellastrada-motorsport.com/ and the booking and purchase of luxury sports car driving experiences offered by Bella Strada Motorsport SL (hereinafter, "Bella Strada"). By making a booking or redeeming a voucher, the customer fully accepts these terms, together with the Legal Notice and the Privacy Policy.
2. Booking process and confirmation
To book, the customer must select the desired experience, vehicle, date and time, complete the form with their personal details and pay the price. The booking will only be considered confirmed when the customer receives the confirmation email. It is the customer's responsibility to check the details of their booking and report any error as soon as possible. Before each experience takes place, the customer must sign a personalised contract setting out the specific conditions of the experience, the vehicle and the obligations of the parties. Signing this contract is an essential requirement for participation.
3. Prices and payment
Prices published on the website are expressed in euros, taxes included. Payment is made in full and in advance through the website's secure payment gateway (Stripe) by card or other available methods. Bella Strada does not store or process payment card data. If the customer requests an invoice, they must indicate this when booking and provide their tax details.
4. Cancellations and refunds
Customer cancellation: the customer may cancel their reservation at no cost provided they communicate it at least 7 days in advance of the date and time of the experience. The customer may change their reservation up to 2 times at no additional cost. In the event that the cancellation is made less than 7 days in advance, such action will entail a financial penalty, the amount of which will be calculated proportionally based on the kilometers contracted in their reservation. Modifications: date or time changes are subject to availability and must be requested two weeks in advance. Cancellation by Bella Strada: if the experience cannot take place due to failure to meet participation requirements, weather conditions, mechanical problems, or other circumstances beyond our control, we will offer the customer the rescheduling of the experience. Refunds: will be issued via the same payment method within a maximum period of 14 days.
To take part in the driving experiences, the customer must: be at least 25 years old (or the minimum age indicated for each experience) and hold a valid driving licence with a minimum of 2 years' driving experience, which must be shown before driving; wear suitable footwear that allows the pedals to be operated correctly; not be under the influence of alcohol, drugs or medication affecting their ability to drive; and meet the physical requirements of the chosen vehicle. Failure to meet these requirements will entitle Bella Strada to prevent the customer from driving without any right to a refund.
6. Driving and safety rules
Driving will always take place following the instructions of the Bella Strada team. The customer accepts that driving high-performance vehicles involves risks and undertakes to comply at all times with the safety rules and the staff's instructions. In the event of reckless conduct or conduct contrary to the instructions, the staff may immediately interrupt the experience, without any right to a refund and with the customer being liable for any damage caused.
7. Liability and damages
The experiences include the vehicle's compulsory insurance cover. Damage to the vehicle resulting from the customer's negligence or failure to follow instructions will be the customer's responsibility up to the established excess applicable to the specific vehicle model booked, except in cases of intent or gross negligence, in which case the customer is liable for the full amount. The customer is also liable for damage caused to third parties as a result of their negligence or intent.
8. Vouchers and promotions
Vouchers and promotional codes are personal, non-transferable and redeemable under the conditions indicated when issued (validity, applicable experience or vehicle, etc.). Each voucher may only be used once and may not be combined with other promotions unless expressly stated. Expired, lost or used vouchers will not be replaced.
9. Right of withdrawal
In accordance with article 103.m) of the Spanish consolidated text of the General Law for the Protection of Consumers and Users, services related to leisure activities are excluded from the right of withdrawal when the contract provides for a specific date or period of performance. Consequently, bookings of experiences are not subject to the 14-day right of withdrawal, without prejudice to the cancellation clause above.
10. Intellectual property
The contents of the website, including those relating to vehicles, trademarks, logos and experiences, are protected by intellectual and industrial property law. Vehicle manufacturers' trademarks belong to their respective owners. Any unauthorised reproduction or use of such contents is prohibited.
11. Modifications
Bella Strada may modify these terms and conditions at any time. The terms in force on the date the booking was made shall apply.
12. Governing law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts having jurisdiction under the applicable law.
